MySORTED Terms of Service

Last updated: 7 September 2026

Please read these Terms of Service carefully. They form a legally binding agreement between you and The SORTED Partnership in relation to your access to and use of MySORTED.

1. Agreement to these Terms

These Terms of Service (“Terms”) are a legal agreement between the person or organisation using MySORTED (“you”, “your” or “Customer”) and The SORTED Partnership (“MySORTED”, “we”, “us” or “our”). These Terms govern your access to and use of the MySORTED website, responsive web application, software-as-a-service functionality, online course content and related services (collectively, the “Services”).

By creating an account, purchasing or accepting an order for Services, accessing the Services, or otherwise using MySORTED, you confirm that you have read, understood and agree to be bound by these Terms and by our Privacy Policy, which is incorporated by reference. If you do not agree, you must not use the Services.

If you use the Services on behalf of an organisation or another legal entity, you represent that you have authority to bind that entity to these Terms.

2. Eligibility and accounts

The Services are intended for persons who are at least 18 years old and have legal capacity to enter into this agreement.

You must provide accurate, current and complete registration, billing and contact information and keep it updated. You are responsible for maintaining the confidentiality and security of your account credentials and for activity carried out through your account, except to the extent caused by our breach of applicable law.

You must notify us promptly if you become aware of unauthorised access to your account or another security breach.

3. Right to use the Services

Subject to these Terms and payment of any applicable fees, we grant you a limited, revocable, non-exclusive, non-transferable right to access and use the Services for your personal purposes and, where the relevant Service permits, your own business or professional purposes.

Your use may be subject to storage limits, feature limits, service descriptions, pricing plans, order terms or other usage levels displayed when you purchase or use the Services.

You are responsible for the equipment, internet connection, telecommunications services and third-party charges required to access the Services.

4. Your content and your rights

“Your Content” means files, documents, photographs, recordings, information, contacts, notes and other data that you or an authorised user upload, store, organise, share or otherwise make available through the Services.

You retain ownership of and all rights in Your Content. We do not acquire ownership of Your Content merely because you use MySORTED.

You grant us only the rights reasonably necessary to host, process, transmit, organise, display and otherwise handle Your Content for the purpose of providing, securing, maintaining and improving the Services, complying with your instructions, and meeting applicable legal obligations.

You represent that you have the right and any necessary consent to upload, store, process or share Your Content and that doing so does not unlawfully infringe the rights of another person.

Where you store information about another person, or share information with another person through MySORTED, you are responsible for ensuring that you have an appropriate lawful basis or permission to do so where required.

5. Privacy, data protection and security

Our collection and use of personal information is governed by our Privacy Policy. We will apply reasonable technical, organisational and administrative safeguards designed to protect personal information and Your Content.

You acknowledge that no internet-connected service, electronic transmission or storage system can be guaranteed to be completely secure or continuously available.

Where the Services use third-party infrastructure, storage, payment processing or other service providers, those providers may process information as necessary to provide their services, subject to applicable law and our contractual arrangements with them.

If we are required by applicable law, court order or lawful governmental request to disclose or process information, we may do so to the extent legally required.

6. Sharing and third-party access

MySORTED may allow you to share selected information or grant access to selected people. You are responsible for deciding what you share, with whom you share it, and the permissions or duration of access you select.

We are not responsible for what an authorised recipient does with information after you have lawfully shared it with that recipient, except to the extent responsibility cannot be excluded under applicable law.

You should review access permissions periodically and revoke access when it is no longer appropriate.

7. Prohibited use

You may not use, and may not permit another person to use, the Services to:

  • break any applicable law or regulation, or facilitate unlawful, fraudulent or abusive activity;

  • upload, transmit or distribute malicious code, viruses, Trojan horses, worms or other harmful material;

  • interfere with, disrupt, overload, probe or attempt to gain unauthorised access to the Services, accounts, networks, systems or data;

  • circumvent or disable security, authentication, access-control or usage-limit features;

  • reverse engineer, decompile, disassemble, copy, modify or create derivative works from the Services except where applicable law expressly permits it;

  • scrape, harvest or collect user information without permission, or use unauthorised bots, scripts or automated extraction tools;

  • impersonate another person, create an account under false pretences, or provide materially false information;

  • send spam, unauthorised advertising or other unsolicited communications through the Services;

  • upload or transmit content that is unlawful, defamatory, threatening, harassing, obscene, hateful, invasive of privacy, or infringes intellectual property or other third-party rights;

  • resell, sublicense or commercially exploit the Services except where we have expressly authorised this in writing; or

  • use the Services in a manner that materially restricts or interferes with another user’s proper use of the Services.

8. Intellectual property

The Services, including their software, source code, databases, functionality, website design, text, graphics, course material, trademarks, logos and other content supplied by MySORTED (“MySORTED Content”), are owned by or licensed to us and are protected by applicable intellectual-property laws.

Except for the limited right to use the Services granted under these Terms, no right, title or interest in the Services, MySORTED Content or MySORTED marks is transferred to you.

You may not copy, reproduce, republish, distribute, sell, license, publicly display or commercially exploit MySORTED Content without our prior written permission, except where expressly permitted by these Terms or applicable law.

9. Feedback and submissions

If you voluntarily provide suggestions, ideas or feedback about MySORTED, you grant us a worldwide, perpetual, irrevocable, royalty-free right to use that feedback to develop, improve, market and operate the Services without compensation to you. This clause does not transfer ownership of Your Content stored in your MySORTED account.

10. Third-party services and links

The Services may contain links to, integrate with, or depend on third-party websites, applications, payment providers, storage providers or other services. We do not control third-party services and are not responsible for their content, availability, acts, omissions, privacy practices or terms.

Your use of a third-party service is governed by your agreement with that provider. The inclusion of a link or integration does not by itself constitute our endorsement of that third party.

11. Fees, payments, promotions and taxes

Prices, storage allowances, features and payment terms are those displayed or agreed when you place your order. You agree to pay all applicable charges using an accepted payment method and to provide accurate payment and billing information.

We may use third-party payment processors for card processing, fraud prevention and related payment services.

Unless a specific offer, order, refund policy or applicable consumer law provides otherwise, fees paid for access already supplied are non-refundable.

Promotional pricing, coupons and special offers may be subject to separate conditions and may be changed or withdrawn for future purchases.

You are responsible for taxes, duties or similar charges that applicable law requires you to pay in connection with your purchase, except taxes imposed on our own income.

12. Lifetime access and other special offers

Where we expressly sell a plan as “lifetime access”, “lifetime storage” or similar, “lifetime” means the lifetime of the individual account holder entitled to that plan, not the lifetime of The SORTED Partnership or the MySORTED business. For a gift purchase, the account holder is the person who redeems the gift. The once-off payment provides that person with access to the purchased plan for their lifetime without recurring plan fees, subject to the storage allowance, features and other conditions stated in the offer at the time of purchase and these Terms. Lifetime access is personal to that account holder and ends upon their death, unless applicable law or a specific written offer provides otherwise.

Any storage allowance, course access, Founding Patron benefit, promotional benefit or other entitlement included in a special offer is subject to the specific terms of that offer and these Terms.

13. Changes to the Services

We may enhance, upgrade, modify, replace or discontinue features of the Services from time to time. We will use reasonable efforts to give appropriate notice if a change materially reduces core paid functionality or if a paid Service is discontinued.

We may introduce optional premium functionality or additional services for an additional charge.

We may temporarily restrict access for maintenance, repairs, upgrades, security reasons or circumstances beyond our reasonable control.

14. Availability, reminders and informational functions

We aim to provide reliable Services but do not guarantee uninterrupted, error-free or continuously available access.

Any reminder, calendar, notification, organisational or information-management feature is provided as a convenience. You remain responsible for monitoring important dates, deadlines, renewals, appointments, legal obligations, financial obligations, medical requirements and other time-sensitive matters. You should not rely on MySORTED as the sole means of remembering or satisfying such obligations.

15. Suspension and termination

We may suspend, restrict or terminate access to all or part of the Services where we reasonably believe that you have materially breached these Terms, used the Services unlawfully or fraudulently, created a security risk, failed to pay an undisputed amount when due, or caused or threatened material harm to the Services, us or another person.

Where reasonably practicable, we may give you an opportunity to remedy a breach before termination, but we may act immediately where necessary for security, fraud prevention, legal compliance or protection of users or systems.

If a paid Service is terminated or discontinued by us for reasons unrelated to your breach, any refund or alternative access will be determined by the applicable offer, order terms and mandatory consumer law.

Following termination, we may provide a reasonable period or mechanism for you to retrieve Your Content where technically and legally practicable. You are responsible for maintaining any copies or backups that are important to you.

16. Disclaimers

To the fullest extent permitted by applicable law, the Services are provided on an “as is” and “as available” basis. We do not warrant that the Services will be uninterrupted, error-free, free of harmful components, compatible with every device or system, or suitable for every purpose.

We do not provide legal, medical, financial, tax, estate-planning or other regulated professional advice through the Services merely by providing tools to organise, store, share or remind you about information. You should obtain appropriate professional advice where needed.

Nothing in these Terms excludes warranties, rights or remedies that cannot lawfully be excluded or limited.

17. Limitation of liability

To the fullest extent permitted by applicable law, neither party will be liable to the other for indirect, incidental, special, exemplary or consequential loss, including loss of profit, revenue, opportunity, goodwill or anticipated savings, arising out of or relating to the Services.

To the fullest extent permitted by applicable law, our total aggregate liability arising out of or relating to the Services or these Terms will not exceed the amount you paid to us for the applicable Service during the 12 months immediately preceding the event giving rise to the claim.

The limitations in this section do not apply to liability that cannot legally be excluded or limited, and nothing in these Terms limits any non-excludable rights you may have under applicable consumer-protection law.

18. Indemnity

To the extent permitted by applicable law, you agree to indemnify and hold us, our partners, personnel and agents harmless from third-party claims, losses, liabilities and reasonable legal costs arising from your unlawful use of the Services, your material breach of these Terms, or Your Content infringing another person’s intellectual-property, privacy or other rights.

We will use reasonable efforts to notify you of a claim for which we seek indemnification and to cooperate reasonably in its defence.

19. Copyright complaints

We respect intellectual-property rights. If you believe material made available through MySORTED infringes your copyright, please send a written notice identifying the copyrighted work, the allegedly infringing material and its location, your contact details, the basis of your claim, and a statement that the information supplied is accurate and that you are authorised to act for the rights holder.

Copyright notices may be sent to: Desmond Kleineibst, Copyright Agent, The SORTED Partnership, 10 Marigold Street, Meedingsride, Sedgefield, 6573, South Africa; email: des@mysorted.com.

20. Electronic communications

You agree that notices, disclosures, agreements and other communications may be provided electronically, including by email, through the Services or by posting on our website, where permitted by law. Electronic acceptance of these Terms has the same effect as signing them in writing.

21. Changes to these Terms

We may update these Terms from time to time. The revised Terms will show an updated “Last updated” date. Where a change is material and applicable law requires notice, we will provide appropriate notice. Your continued use of the Services after revised Terms take effect constitutes acceptance of those revised Terms, subject to applicable law.

22. Governing law and disputes

These Terms and your use of the Services are governed by the laws of the Republic of South Africa, without regard to conflict-of-law principles.

Before commencing formal proceedings, you and MySORTED should first attempt in good faith to resolve any dispute informally by written notice and reasonable discussion.

Subject to any mandatory consumer-protection rights or other laws that give you the right to bring a claim elsewhere, the courts of the Republic of South Africa will have jurisdiction over disputes arising from or relating to these Terms or the Services.

23. General terms

These Terms, together with the Privacy Policy and any applicable order, offer terms or service description, constitute the agreement between you and us regarding the relevant Services.

If there is a conflict between a specific written offer or order and these Terms, the specific offer or order will prevail only to the extent of that conflict and only for the applicable Service.

If any provision of these Terms is held invalid or unenforceable, the remaining provisions will remain in effect.

Our failure to enforce a provision is not a waiver of our right to enforce it later.

We may assign our rights and obligations in connection with a merger, reorganisation, sale of business or assets, or to an affiliated or successor entity, subject to applicable law. You may not transfer your account or your rights under these Terms without our written consent.

Neither party is responsible for delay or failure caused by events beyond its reasonable control for so long as those events continue.

Nothing in these Terms creates an employment, agency, fiduciary, joint-venture or partnership relationship between you and us.
